Firestone fluorite mining and production control

Notice of the General Office of the State Council on Adopting Comprehensive Measures to Control the Exploitation and Production of Refractory Clay Fluorspar Guo Guo Fa [2010] No. 1

The people's governments of provinces, autonomous regions, and municipalities directly under the Central Government, the ministries and commissions of the State Council, and the agencies directly under the State Council:
Fireclay and fluorite are valuable resources that are exhausted and non-renewable. In recent years, some enterprises have over-exploited and produced refractory clay and fluorite, which led to a rapid decline in reserves of resources and serious environmental pollution. In order to fully implement the scientific development concept and protect resources and the environment, it is necessary to take comprehensive measures from the aspects of mining, production planning management, taxation, environmental protection, industrial access, and export management to control the exploitation of refractory clay and fluorite. Production. With the approval of the State Council, the relevant matters are hereby notified as follows:
First, the total amount of mining and production shall be used to control the total amount of mining and production of refractory clay and fluorite so that the amount of exploitation and production will decrease year by year. The Ministry of Land and Resources issued the annual total control index of refractory clay (high-aluminum clay minerals), fluorspar, and annual total mining control targets. Each province (region, city) land and resources management department is responsible for decomposing the relevant total control indicators Reached the corresponding mining enterprises; National Development and Reform Commission studied and proposed the annual production total directive plan, the Ministry of Industry and Information Technology issued sub-regional annual production directive plan, provincial (autonomous regions, municipalities) industry and information management departments responsible for Relevant production directives plan to reach the corresponding production enterprises. All relevant departments should make a good connection between mining control indicators and production-instruction plans. The provincial (autonomous regions, municipalities) Development and Reform Commission, the Ministry of Industry and Information Technology and the Ministry of Land and Resources Management reported the implementation results of the mandatory plans and control targets for the previous year to the National Development and Reform Commission, the Ministry of Industry and Information Technology and the Ministry of Land and Resources respectively. .
II. Strictly controlling new production capacity As of the date of this circular, the land and resources management department will no longer accept applications for the registration of new fireclay (high-alumina clay minerals) and fluorite. It is necessary to strengthen the regulation and rectification of the mining order of fire-resistant clay (high-alumina clay minerals) and fluorite resources, and phase out mining enterprises that destroy resources, pollute the environment, have unreasonable layout, fail to meet safe production conditions, and are technologically backward, and ban unlicensed mining according to law. . For construction projects that do not meet the national industrial policy and market access conditions, the land, planning, construction, environmental protection, and safety production supervision departments will not handle the relevant procedures.
III. Actively promote the adjustment of industrial structure All regions and departments must formulate concrete measures to support the environmental protection and energy-saving transformation of fire-resistant clay and fluorite enterprises, promote new technologies, new processes with high efficiency, low energy consumption, and environmental protection, and promote industrial restructuring. The Ministry of Industry and Information Technology shall work with relevant departments to formulate standards for access to the refractory clay and fluorspar industry, and strictly meet the requirements for scale, technology, energy conservation, consumption reduction and environmental protection, and eliminate backward production capacity. All regions must strictly follow entry conditions to strengthen access management, prevent blind investment, and eliminate outdated production capacities with low technological levels and serious pollution in accordance with the prescribed deadlines. Industry access standards will be implemented from March 1, 2010.
4. Effectively implement export measures While reducing the production of refractory clay (high-alumina clay minerals) and fluorspar, as well as the production volume of fluorspar, we must continue to use existing export measures to achieve mining and production restrictions, taking into account the reasonable demands of the international market. Measures and trade links management measures are balanced. The Customs must step up crackdowns on smuggling and ensure relevant export measures are implemented.
V. Raising the resource tax rate will effectively reduce the exploitation of refractory clay and fluorite, rationally guide market demand, protect the ecological environment, and increase the resource tax rates for fire-resistant clay and fluorspar. The adjustment of the specific tax standard shall be determined separately by the relevant department of the Ministry of Finance in the scope of the tax amount of the current Provisional Regulations on Resources Tax.
6. Strengthen environmental protection supervision Each local environmental protection department shall formulate laws and regulations concerning environmental protection for strengthening fire-resistant clay and fluorspar, incorporate fire-resistant clay and fluorspar related enterprises into the list of key monitoring companies, further strengthen law enforcement, and increase the exploitation of fire-resistant clay and fluorite. The supervision, inspection, and evaluation of the environmental protection status of production enterprises, the strengthening of the supervision of tailings disposal, and the timely reporting of relevant supervision and inspection to the environmental protection departments of higher levels of government. For fireclay and fluorite mining and production enterprises that exceed pollutant discharge standards or cause serious environmental pollution, they shall be ordered to govern within a time limit; units that have failed to complete overdue governance tasks within the prescribed time limit shall be reported to the local government for suspension or closure.
VII. Strengthening information guidance The Ministry of Industry and Information Technology, the Ministry of Land and Resources and the Association of Trade and Industry, etc. shall strengthen research on the changes in the market of fire-resistant clay and fluorite at home and abroad, release market information in a timely and accurate manner, and correctly guide fire-resistant clay and fluorite. The investment, mining and production will guide enterprises to implement national industrial policies, promote the use of advanced and applicable technologies, and increase their competitiveness.
VIII. Strengthen Supervision and Inspection All regions and relevant departments must strengthen supervision and inspection to ensure that the above-mentioned policies and measures are put in place. For the provinces (autonomous regions and municipalities) that have produced or produced quantities that exceed the total quantity control targets or mandatory plans issued in the current year, the National Development and Reform Commission, the Ministry of Industry and Information Technology, and the Ministry of Land and Resources separately notified and criticized and cut back on the next year. The total amount of control indicators or mandatory plans.
